Terms of Service

Twin Peaks Lodging LLC (“TPL”) operates a short term rental operation located on the premises of 12274 E Willow Loop Road, Brighton, Utah (the “Property”) under a lease agreement with the Reynolds Family Trust (“RFT”). RFT accepts no liability for those injuries or any damages sustained on the Property by short term rental guests, their guests and/or other third parties and cannot be held responsible for any inconvenience, damage, injury or loss to persons or properties, directly or indirectly, by weather, negligence, or wrongful act by any third party or circumstances beyond the direct control of RFT.

Short Term Rental Guest: the Short-Term Rental Guest is collectively referred to below as (“you”), the (“Guest”) or the (“Renter”).

Cancellations: TPL offers a full refund for reservations cancelled 60+ days in advance from the arrival date. Cancellations made 30-59 days in advance will receive a 50% refund. If TPL is able to rebook your dates and the same rates, we will provide you a full refund minus a 3% credit card processing fee plus taxes.   Reservation Deposit: A 50% deposit is required at the time of booking. The balance of the rental fee will be automatically processed 30 days prior to occupancy to that credit card held on file. As a courtesy, we will notify you as to the pending charge to that credit card. If there is a problem processing the balance on this date, your deposit payment will be fully or partially forfeited, should we be unable to rent the accommodation to another party under terms of a similar rate. In accordance with standard accounting practices, that deposit shall be released to TPL 30 days in advance of the reservation when the balance of the rental fee is due and paid.

Security Deposit: A valid credit card will be required at the time of booking and held on file. After the Guest has checked out, TPL will inspect the property for damages. Any damage, missing inventory, or other unpaid charges will be discussed with you and billed to your credit card.

Check-In and Check-Out: Check-in is after 4:00 p.m. and Check-out is before 10:00 a.m. Early arrivals and late departures are not possible in winter (mid-December until mid-April). In non-winter months, early arrivals and late departures must be arranged and approved in advance with TPL. Limit of Liability: In the event that the property becomes unavailable or uninhabitable due to circumstances beyond our control, we reserve the right to offer a full refund as compensation. TLP cannot be held responsible for any inconvenience, damage, injury or loss to persons or properties, directly or indirectly, by weather, negligence, or wrongful act by any third party or circumstances beyond the direct control of TPL.

Limit of Liability: In the event that the property becomes unavailable or uninhabitable due to circumstances beyond our control, we reserve the right to offer a full refund as compensation. TLP cannot be held responsible for any inconvenience, damage, injury or loss to persons or properties, directly or indirectly, by weather, negligence,
or wrongful act by any third party or circumstances beyond the direct control of TPL.

Smoking and Pet Policy: TPL is a nonsmoking property. Guests must agree to smoke outside and well away from the home. Pets are not allowed in Big Cottonwood Canyon – citations will be given by local law enforcement. Licensed service dogs are allowed solely under those provisions established by the Salt Lake County Watershed Division with advance approval by TPL. The Renter’s failure to adhere to those provisions could subject them to fines and/or other penalties imposed by the City of Brighton or the Salt Lake City Watershed Division.

Monitoring Devices
: There are monitoring devices installed inside and outside the property to detect excessive noise levels. These devices do not record any conversations, but rather, strictly detect and notify TPL as to an excessive level of noise that may be disruptive to the surrounding community. The property is also equipped with door-open detection devices on the outside doors that notify the Guests and request that they close any outside doors that have been left open for more than five minutes. The property is also equipped with SMART
thermostats that contain low temperature alarms. Both of these devices help protect the interior space of the property from excessively low temperatures.

Roof Avalanches (winter months): snow can slide off the steep pitched metal roofs at any time without warning, often, days after a snow storm and, those snow slides can extend up to 50’ away from the house. Please avoid slides paths underneath the eaves and away from these roofs. Children playing in the snow are at particularly at risk. These outside activities should be constantly monitored to ensure they avoid these avalanche prone areas. And rather, should rather be directed towards those areas outside these slide paths, specifically, the side of the middle deck and backside of the house.

Property access during inclement weather: the property is located on a one-way single lane road that loops through the subdivision with two steep grades above the property where traction can be difficult during inclement weather. It is for this reason that Guests are encouraged but not required to avoid these steep grades to access the property during inclement weather by driving in the reserve direction on the one-way road, of course, yielding to any oncoming traffic.

IMPORTANT DISCLOSURE: Special Events including commercial weddings, concerts, or parties for Commercial purposes not otherwise permitted in a residential zone are not permissible under TPL’s business license. Private functions, including small family weddings and other types of private gatherings and events are allowed with the advance approval of TPL.. We apologize for any limitations this may put on your plans to stay with us, but please understand that TPL must (and will) make every effort to monitor, enforce and protect the property and avoid disrupting residents in the surrounding community. In the event that you are found to have violated this rule, you may face eviction from the property and/or other legal or financial penalties.

No short-term rental in the Town of Brighton may be used for Special Events including commercial weddings, concerts, or parties or Commercial purposes not otherwise permitted in the zone.

 

No short-term rental can exceed a maximum of 15 adults overnight. (The restriction does not pertain to the number of children accompanying their parents, nor does it pertain to those adult guests who may be attending a private event at the property and do not stay overnight.) Occupants of a short-term rental shall not create excessive noise. Quiet hours are 10 pm-7 am.

Open fires or fire pits of any kind must be conducted strictly under Owner supervision. Please make arrangements in advance with TPL.

Overnight parking must be onsite. There are parking areas adjacent to the Brighton Store and at the Brighton Ski Resort; neither of which allow for overnight parking, particularly, during the winter months where the lots must be cleared of snow.

Payments: Payments can be made by: Visa, MC, Discover, and AMEX.

Reservations and Holds: All reservations require a deposit to hold chosen dates. Holds can be arranged for up to 48 hours.
